How Much Compensation Will I Get?
Below is a guide to the amount of compensation you could receive for injuries suffered as a result of an accident. Awards for compensation are broken down into different categories, and the calculation of each claim is based on the extent of the injury suffered, and each case is decided on its own merits. The following values will give you an indication of the level of compensation you may be entitled to, but should be viewed as a guide only as there are many different factors to consider when calculating compensation.
The figures below are based on guidance produced by the English Judicial Studies Board (the ‘Guidelines for the Assessment of General Damages in Personal Injury Cases’). These guidelines set out suitable personal injury levels for lawyers to advise clients. These were first published in 1992 and are commonly referred to as the ‘JSB Guidelines’. The current figures are from the thirteenth edition, published in 2015.
Our solicitors will give you a full explanation of how compensation for your personal injury is calculated. You may also be entitled to a modest level of interest on top of your compensation; if this is appropriate for your claim, our solicitors will advise you on appropriate rates of interest.
You can also claim compensation for areas of loss other than injury; this includes compensation for loss of earnings; compensation for services, which covers help given by a member of the family who has cared for you following the accident and can also cover any domestic help costs incurred which you would otherwise have done yourself. It is also possible to claim for any costs directly related to the injury, such as prescription and medical treatment costs, damage to property at the time of the accident and pension or bonus loss. You can also claim for ‘loss of society’. This is where the close family of a deceased victim of an accident can claim compensation for the loss of a loved one. ‘Loss of support’ can also be claimed by a partner or family where the deceased is the financial provider.
Compensation for Head and Brain Injuries
Head, brain and spinal cord injuries can have a catastrophic effect on the injured and their families. Compensation is calculated according to the severity of the injury, and factors such as the likelihood of recovery, and the time for recovery are also taken into account. It is also possible to where an injury has caused the onset of an epileptic condition. Our solicitors will be able to advise you on how much you are likely to receive for your compensation claim.
