If you have undergone cosmetic surgery and are unhappy with the results, you may be able to bring a claim in negligence against your surgeon. If successful, you would be able to recover compensation for your pain and suffering, including any psychological distress together with the costs of revisionary surgery if this is required. Breast Augmentation / Uplift Claims

Breast augmentation or uplift surgery (mastopexy) is a procedure whereby the breasts are lifted to reduce sagging. The procedure also involves the repositioning of the nipples. We have seen several problems associated with this type of surgery, including asymmetry of the breasts and/or nipples, loss of sensation in the breasts and/or nipples, and excessive scarring.

Breast Reduction Claims

On occasion, it is necessary to undergo breast reduction surgery for medical reasons — if the patient is experiencing problems with posture and back pain, for example. Breast reduction may also be sought for cosmetic reasons. Whilst some scarring is expected from this type of surgery, we have seen case where the scarring has been excessive. Likewise, there is a risk of breast asymmetry and loss of sensation, as well as a risk of infection, which can result in further scarring.

Breast Implant Claims

We have also seen an increase in younger patients opting for this kind of surgery. Unfortunately, there are some problems associated with breast implant procedures, including:

  • Hardening or rupture of the implants, resulting in misshapen breasts
  • Infection
  • Visible creasing or rippling of the implant under the skin
  • Reduction of feeling/sensation

Nose Reshaping / Rhinoplasty Claims

Nose reshaping (rhinoplasty) has been a common type of cosmetic surgery for many years now. It can be undertaken to reduce or enlarge the nose, alter the bridge or tip of the nose, alter the size of the nostrils, or restore the nose to its original shape after an accident.

We have seen a range of problems arising after nasal surgery, and the delicate nature of the procedure means that it is particularly important in this field to ensure that your surgeon is an expert. Problems may arise which reduce the ability to smell, or make it difficult to breathe. Patients can also experience problems with abnormal bleeding, and there are of course psychological impacts if the nose is reshaped incorrectly.

Ear surgery / Otoplasty Claims

Ear surgery is often undertaken to pin back or reshape prominent ears. Thankfully, this type of surgery is usually carried out competently, resulting in a positive outcome for the patient. On occasion, however, we have assisted clients who have experienced a less then satisfactory outcome, resulting in an uneven appearance.

Facelift / Rhytidectomy Claims

Facelift procedures involve pulling back loose skin from the face and jaw to result in a smoother, younger appearance. However, we have seen cases where the surgery has sadly resulted in excessive scarring which is visible behind the ears. Other risks involve nerve damage to the face, which can result in facial numbness, or at worst, paralysis of the facial muscles. Other risks include uneven features and excessive bleeding or clotting.

Brow Lift Claims

Brow lift surgery involves lifting the forehead for cosmetic purposes to create a smoother look. The procedure involves removing muscle and tissue from the face, and there is therefore a risk of nerve damage and unevenly sited brows.

Tummy tuck / Abdominoplasty Claims

A tummy tuck, or abdominoplasty, is a procedure whereby excess fat and skin is removed from the patient’s stomach in order to create a flatter appearance. Unfortunately, there are some common adverse outcomes to this procedure, including excessive scarring, infection, nerve damage and blood clots.

Liposuction Claims

Liposution is a very common type of surgery, and involves sucking fat out from under the skin to create a slimmer appearance. Sadly, we have seen many adverse outcomes of this procedure, some of which can be life-threatening — including infection, perforation of the organs, and unsatisfactory cosmetic outcome in cases where too much fat has been removed.

Eyelid Surgery / Blepharoplasty Claims

Eyelid surgery is a procedure that involves the removal of skin and tissue from the upper and/or lower eyelids. This is obviously a very delicate area, and there is a risk that problems can arise as a result of the surgery. Some examples of this include bleeding behind the eye, an inability to fully close the eyes, and asymmetrical appearance.

Laser Skin Resurfacing Claims

Laser skin resurfacing is a procedure whereby the top layer of skin is removed to encourage smoother, more youthful skin to grow in its place. Sadly, this procedure can have some very unfortunate outcomes, including permanent scarring and/or the development of noticeable pigmentation.

Non-Surgical Cosmetic Procedure Claims

The popularity of non-surgical cosmetic treatments has been rising rapidly over recent years, and treatments such as Botox and dermal fillers are now offered in many beauty salons and dental clinics. While non-surgical cosmetic treatments are often thought of as less risky than plastic surgery, this is not always the case, especially when those administrating the procedures do not have adequate training. The products used in non-surgical cosmetic procedures can result in permanent adverse effects, and we have seen incidents where too much of a product has been used. Worryingly, we have also seen cases where these products have been administered in party-type situations where the patients have not been given adequate information about the risks, and therefore have not been able to give their informed consent.

Dental Negligence Claims

If you believe that the dental treatment you have received has fallen below an acceptable standard and has resulted in problems of complications for you, you may be able to make a claim for compensation. Some common problems which occur from time to time are as follows:
